These Terms and Conditions (“Terms”) govern your access to and use of the NyumbaNext web application, website, and related services (collectively, the “Platform”), owned and operated by Nyumba Next Agencies.
By creating an account, accessing, or using the Platform, you agree to be legally bound by these Terms.
Eligibility & Account Registration
- You must be at least 18 years old.
- Information provided must be accurate and truthful.
- You are responsible for your login credentials.
- You are responsible for all activity under your account.
Platform Role
- The Platform is a technology marketplace only.
- We do not own, verify, or inspect properties.
- We are not agents, brokers, or legal representatives.
- All transactions occur solely between users.
User Conduct
- No fraudulent or misleading listings.
- No impersonation.
- No harmful or illegal content.
- No security bypass attempts.
Seller Responsibilities
- Must have legal authority to list property.
- All information must be accurate and updated.
- Must comply with applicable laws.
Buyer Responsibilities
- Listings are user-generated and unverified.
- Conduct independent inspections and due diligence.
- Statistics and availability are not guaranteed.
Payments & Fees
- Some services may require payment.
- Fees are non-refundable unless stated.
- Third-party payment terms apply.
Limitation of Liability
To the maximum extent permitted by law, Nyumba Next shall not be liable for financial loss, fraud, lost profits, property damage, or emotional distress. Liability shall not exceed fees paid in the previous 6 months or KES 5,000 (whichever is lower).
Governing Law
These Terms are governed by the laws of the Republic of Kenya. Disputes shall be subject to Kenyan courts.
